1. Agreement to these Terms
These Terms of Service (“Terms”) are a legal agreement between you and PinkPulse Limited (“PinkPulse,” “we,” “us,” or “our”) governing your use of RollChoice, including its website, account features, Free features, Premium features, and related services (the “Service”).
By accessing or using the Service, creating an account, or purchasing Premium, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
- You must be at least 13 years old to use RollChoice. If you are under the age of legal majority where you live, you may use the Service only with permission of a parent or legal guardian where required.
- You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account unless caused by our failure to use reasonable security measures.
- You may not impersonate another person, create an account for unlawful purposes, or attempt to access another user’s account or protected data.
- You must be authorized to use any payment method you provide for a Premium purchase.
3. What RollChoice provides
RollChoice is a decision-making web application with two core types of tools:
- Roll it: randomized or ritual-style tools such as coin, dice, spinner, and qian that select from available options.
- Worth it: a scoring interface that calculates a result from the ratings or inputs you provide.
The Service may also include starter roll sets, custom roll sets, the Settings and Billing pages, and Decision history for eligible Premium users. Features may differ by account state, device, location, or plan.
4. Free and Premium access
RollChoice may offer Anonymous, Authenticated Free, and Premium experiences. Free users may have access to only certain starter roll sets, Roll it tools, or pages. Premium may unlock all starter roll sets, all supported Roll it tools, custom roll set features, Worth it tie-break functionality, and retained Decision history, as described in the Service at the time of use.
Premium entitlement is determined by trusted account and billing records. A client-side display, saved URL, local-storage value, or other interface state does not create a Premium entitlement.
5. Premium subscriptions, billing, and cancellation
5.1 Subscription charges
Premium is a recurring paid subscription unless the Subscribe to Premium page expressly states otherwise. The price, billing interval, currency, taxes, and included features shown on the Subscribe to Premium or Pricing pages apply to your purchase. We may change pricing prospectively, subject to notice required by law.
5.2 Automatic renewal
Unless canceled, a recurring Premium subscription automatically renews at the applicable interval and your payment method may be charged for the next billing period. You authorize us and our payment processor to charge the payment method associated with your subscription for amounts due.
5.3 Payment processing
Payments and subscription billing may be processed through Stripe or another third-party payment provider. Your use of a provider’s payment interface may also be subject to that provider’s terms and privacy policy.
5.4 Cancellation
You may cancel an eligible subscription through Settings or the Billing page made available to your account. Unless the Service states otherwise, cancellation stops future renewals and Premium remains available through the end of the already-paid billing period. Cancellation of Premium does not automatically delete your RollChoice account.
5.5 Refunds
Except where required by applicable law or expressly stated in a separate refund policy or a term presented on the Subscribe to Premium page, fees already paid are non-refundable and we do not provide prorated refunds for unused time. If you believe a charge is incorrect, contact us promptly at the support email below.
5.6 Billing status and downgrade
If payment fails, a subscription is canceled, or entitlement otherwise ends, Premium features may become unavailable. User-owned Premium data may remain stored but inaccessible rather than being immediately deleted, subject to the Privacy Policy and applicable retention rules.
6. Your content and custom roll sets
“User Content” means content you submit or save in RollChoice, such as custom roll set names, questions, options, and related settings. You retain ownership of your User Content.
You grant PinkPulse Limited a limited, worldwide, non-exclusive license to host, store, reproduce, process, transmit, and display User Content only as reasonably necessary to operate, secure, maintain, support, and improve the Service, comply with law, and enforce these Terms. This license ends when the content is deleted from active systems, subject to reasonable backup, legal, security, and retention requirements.
You are responsible for your User Content and must have the rights necessary to submit it. Do not use RollChoice as a repository for passwords, payment-card numbers, government identifiers, confidential third-party information, or other highly sensitive records.
7. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, abusive, harassing, or harmful activity.
- Upload or store content that infringes intellectual property, privacy, publicity, or other rights of another person.
- Attempt to bypass Premium restrictions, authorization controls, rate limits, security controls, or access data belonging to another user.
- Probe, scan, exploit, reverse engineer, disrupt, overload, or interfere with the Service except to the extent such restriction is prohibited by applicable law.
- Use automated means to scrape or access the Service in a manner that materially burdens systems or violates published technical restrictions.
- Introduce malware, malicious code, or content intended to compromise systems or users.
- Misrepresent a RollChoice result as professional advice, an official determination, or a guaranteed prediction.
8. Important decision-making disclaimer
RollChoice is designed for everyday choices and personal reflection. Outcomes from Roll it are chance-based or tool-based selections from available options. Worth it scores are calculations based on inputs you provide. Neither is an objective determination of what you should do.
Do not rely on RollChoice as the sole or primary basis for medical, mental-health, legal, tax, financial, investment, credit, insurance, employment, immigration, personal-safety, emergency, gambling, or other high-stakes decisions. Seek qualified professional help or emergency services when appropriate. You remain responsible for evaluating options and deciding whether to act on any RollChoice output.
9. Service availability and changes
We may add, modify, suspend, or discontinue features, plans, or parts of the Service. We aim to avoid materially reducing a paid subscription during an already-paid period without a legitimate operational, security, legal, or product reason. We do not guarantee that the Service will always be uninterrupted, error-free, or available on every browser, device, or network.
We may perform maintenance, respond to security incidents, apply usage limits, or temporarily restrict access when reasonably necessary to protect the Service or users.
10. Intellectual property
The Service, including the RollChoice name, software, interface, design, logos, visual assets, 3D models, starter roll sets, documentation, and other content supplied by PinkPulse Limited, is owned by or licensed to PinkPulse Limited and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
You may not copy, sell, license, distribute, publicly exploit, or create derivative commercial products from protected RollChoice materials except with our written permission or as allowed by applicable law.
11. Feedback
If you voluntarily send us suggestions or feedback about RollChoice, you grant us permission to use that feedback without restriction or compensation, provided we do not publicly identify you as the source without permission.
12. Third-party services
RollChoice may depend on third-party services for hosting, authentication, database functions, payment processing, billing, email, monitoring, or other infrastructure. Those providers may have separate terms and privacy policies. We are not responsible for third-party services that are outside our control, but we remain responsible for our own obligations under applicable law.
13. Suspension and termination
You may stop using RollChoice at any time. For account deletion or data requests, contact support@rollchoice.com, subject to the Privacy Policy. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, fail to pay applicable fees, abuse the Service, or where suspension is reasonably necessary to protect users or systems.
Where reasonably practicable, we will provide notice before termination for a remediable breach. We may act immediately for serious abuse, fraud, security threats, legal requirements, or unauthorized access attempts.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” PinkPulse Limited disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that RollChoice outputs are correct, optimal, complete, or suitable for your circumstances. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by applicable law, PinkPulse Limited and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, or business interruption arising from or related to the Service, even if advised that such loss is possible.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to PinkPulse Limited for RollChoice during the 12 months before the event giving rise to the claim or (b) US$100. This limitation does not apply where liability cannot legally be limited, including any liability that applicable law requires us to bear.
16. Your responsibility for misuse
To the extent permitted by law, you are responsible for losses, claims, or costs resulting from your unlawful use of the Service, infringement of another person’s rights through your User Content, or intentional circumvention of RollChoice security or access controls.
17. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. The courts of Hong Kong have non-exclusive jurisdiction over disputes relating to these Terms or the Service, except that mandatory consumer-protection law may allow you to bring a claim in another competent court or require different rules to apply.
Before filing a formal claim, we encourage you to contact us at support@rollchoice.com so we can try to resolve the issue informally. This does not limit any right to seek urgent relief or use a regulator, tribunal, small-claims procedure, or other process available under applicable law.
18. Changes to these Terms
We may update these Terms as RollChoice evolves or legal requirements change. If a change materially affects your rights or a paid subscription, we will provide reasonable notice where required. By continuing to use the Service after updated Terms become effective, you agree to the revised Terms to the extent permitted by law. If you do not agree, you should stop using the Service and cancel any recurring subscription before its next renewal.
19. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy, and any terms presented on the Subscribe to Premium page form the agreement between you and PinkPulse Limited regarding RollChoice.
- Severability. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law.
- No waiver. A delay in enforcing a provision is not a waiver of the right to enforce it later.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a corporate reorganization, financing, merger, acquisition, or sale of the relevant business, subject to applicable law.
- Language. If these Terms are translated, the English version controls to the extent permitted by law unless applicable law requires otherwise.
